The High Court of Cassation and Justice dismissed the petition for the transfer of jurisdiction (strămutare) filed by the plaintiffs, ruling without appeal in favor of the status quo. The dispute involved a procedural request to relocate a pending civil appeal case from the Suceava Court of Appeals to another court. The court rejected the transfer because, at the time of the hearing, the referred case already had a scheduled hearing date of February 25, 2014, and the petitioners were absent despite legal summons. The decision rests on the procedural doctrine that jurisdictional transfer is not admissible or necessary when the original court has an imminent, established hearing schedule and the requesting parties failed to justify why the transfer was required under the applicable procedural codes.
