Transfer request moot; petition dismissed as case already decided

The High Court of Cassation and Justice (Civil Section I) dismissed as moot the petitioner's request to transfer (strămutare) the civil case File No. 1754/297/2011* pending before the Botoșani Tribunal, because the underlying case had already been decided on 9 April 2014, so the transfer request no longer had an object. The court, following the prosecutor's recommendation, ruled against the petitioner and ordered no appeal. The decision was based on the procedural principle that a request for case transfer becomes devoid of purpose once the case it seeks to move has been finally resolved, leaving the transfer application without a live subject matter.
