Municipal annulment challenge withdrawn; proceedings terminated per abandonment, prior ruling undisturbed.
Legislator summary
AI generatedThe court took formal note of the petitioner's withdrawal of its annulment challenge, thereby terminating the proceedings without ruling on the merits; the prior decision (no. 184 of 22 January 2003) remains in force. The case involved a challenge brought by the municipality against a prior Supreme Court ruling concerning amounts and late-payment penalties established in a 2001 audit report of the Court of Accounts, which the petitioner argued were automatically cancelled under Article 169 of Government Emergency Ordinance No. 61/2002 on the collection of budgetary claims. Because the petitioner expressly renounced the claim at the hearing, the court applied Article 246 of the Code of Civil Procedure and took act of the abandonment, making no determination on the substantive legal issues.

Asupra recursului de față;
