The Supreme Court (High Court of Cassation and Justice) declared all appeals (recurs) filed by the claimant and the defendants as perished (perimate), thereby leaving in force the appellate decision that had ordered the state authorities to issue a restitution order for the claimant’s half-share of an immovable property. The dispute originated from a 2003 claim for in-kind restitution of property rights under Law no. 10/2001, which was initially dismissed by the first-instance court but reversed by the Court of Appeal, which ordered the relevant ministry and local culture directorate to restore the property. The legal basis for the final decision was procedural: the appeal process had been suspended pending the resolution of related cases, and because the statutory time limits for resuming the proceedings expired without the parties taking further action, the Supreme Court applied Articles 248 and 252 of the Code of Civil Procedure to formally perime the appeals, rendering the appellate decision final and unenforceable by further higher court review.

248 C. proc. civ., astfel că, potrivit art. 252 C. proc. civ., se impune constatarea perimării tuturor recursurilor deduse judecății.
