Appeal lapsed for inaction; peremption terminates proceedings.
Legislator summary
AI generatedThe High Court of Cassation and Justice (Civil Section I) declared the appeal (recurs) filed by the claimant to be perimted (lapsed) and thus irrevocably terminated the proceedings, leaving the lower appellate decision of 16 June 2004 in force. The case arose from a civil appeal challenging that appellate decision; after the court had suspended the proceedings on 3 October 2007 under Article 155¹ of the Civil Procedure Code, the case remained dormant for over a year due to the parties' inaction. On 4 May 2010, the court reinstated the case sua sponte to address the lapse. The court applied Articles 248 and 252 of the Civil Procedure Code, holding that because the parties failed to pursue the case for more than one year, the appeal was perimted as a matter of law.
