Civil appeal inadmissible for wrong forum; case remanded to Tribunal under prior procedural law
Legislator summary
AI generatedThe Supreme Court of Justice dismissed the appeal for jurisdiction, ordering the transfer of the case back to the Călărași Tribunal for processing under the procedural law in force at the time of the lower court's decision. The dispute involved a civil judgment rendered on May 21, 2003, against which an appeal was filed by a commercial entity; the case was erroneously forwarded to the Supreme Court rather than the competent appellate court. Relying on Article II(3) of Emergency Governmental Ordinance No. 58/2003 and Article 725(4) of the Code of Civil Procedure, the Court held that judgments pronounced before the entry into force of the new legislation (August 28, 2003) remain subject to the appeal routes and deadlines prescribed by the law under which they were rendered, thereby establishing that the Tribunal was the correct recipient for the appeal in accordance with the prior procedural framework.

Analizând regularitatea sesizării sale, constată următoarele:
În conformitate cu dispozițiile art. II alin.
