The Supreme Court of Cassation and Justice (Secția de Contencios Administrativ și Fiscal) ordered that the appeal (recurs) filed against a civil judgment of the Giurgiu Tribunal dated 15 May 2003 be returned to that tribunal for proper forwarding to the competent court, thus rejecting the direct submission to the Supreme Court. The dispute concerned procedural venue for an administrative appeal, with the court holding that under Article II paragraph (3) of Emergency Ordinance No. 58/2003 (in force from 28 August 2003) and Article 725 point 4 of the Civil Procedure Code, judgments issued before the new law's entry into force remain subject to the appeals and deadlines of the law under which they were pronounced; therefore, the appeal filed before that date was correctly lodged at the Giurgiu Tribunal under Article 302 of the Civil Procedure Code, and the case had been erroneously forwarded to the Supreme Court. The court thus prevailed on the procedural point, remanding the case for transmission to the appellate court with jurisdiction under the pre-28 August 2003 procedure.

Art. II alin. (3) din O.U.G. nr. 58/2003

Basis for determining that the appeal remains subject to the procedural rules in force when the judgment was pronounced, i.e., before the entry into force of the ordinance.

Art. 725 pct. 4 C. proc. civ.

Basis for the same rule as in Art. II alin. (3), that judgments remain subject to the appeals and time limits provided by the law in force when they were pronounced.

Art. 302 C. proc. civ.

Basis for the correct filing of the appeal with the Tribunal, as the procedural rule applicable at the time the judgment was pronounced.

Analizând regularitatea sesizării sale, constată următoarele:

În conformitate cu dispozițiile art. II alin.
