Transitionary Law Applicability: Remand of Appeal for Incorrect Jurisdictional Routing under Pre-Reform Civil Procedure Deadlines
Legislator summary
AI generatedThe High Court of Cassation and Justice remanded the case to the first-instance court of Slobozia, effectively declaring its own lack of jurisdiction to hear the appeal and leaving the lower court's civil judgment as the only valid operative decision pending correct procedural forwarding. The dispute concerned the proper procedural channel for an appeal (recurs) against a civil judgment rendered in August 2003, which had been erroneously transmitted to the High Court by the lower court. Applying the transitional provisions of Emergency Ordinance No. 58/2003 and Article 725(4) of the Civil Procedure Code, the Court held that judgments pronounced before the ordinance's effective date of August 28, 2003, remained subject to the appeal routes and deadlines of the previous law, meaning the appeal had to be processed by the lower court rather than the High Court.

Confirms the transitional rule that pre-effective-date judgments follow the procedural deadlines and routes of the old law, supporting the procedural correction in the dispositive.

Analizând regularitatea sesizării sale, constată următoarele:
În conformitate cu dispozițiile art. II alin.
