The High Court of Cassation and Justice dismissed the request for transfer of jurisdiction, ruling that the application was unfounded and leaving the case within the original competence of the Court of Appeal of Constanta, with the decision being final and without further appeal. The dispute involved a civil matter where the petitioner sought to transfer the case from the Court of Appeal of Constanta to the High Court, while the respondent had filed a written opposition and the Prosecutor of the High Court concluded against the transfer; the magistrate noted that the underlying proceedings had been suspended on March 18, 2014, pursuant to Article 1551 of the Civil Procedure Code. The court’s decision rests on the legal standard that the request for transfer was not substantively grounded, resulting in the rejection of the motion under the procedural rules governing jurisdictional transfers.
