Appeal for lack of stated legal grounds declared null; lower rulings upheld.
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the claimant's appeal (recurs) null, thereby upholding the lower court decisions: the trial court's rejection of the motion to annul a prior ruling and the appellate court's dismissal of the related appeal. The underlying dispute involved a motion to annul an interlocutory order, with the claimant arguing his application was mischaracterized (as based on Law No. 10/2001 rather than Law No. 247/2005) and that jurisdiction lay with the trial court. The Court based its ruling on Articles 304 and 306(1) of the Romanian Code of Civil Procedure, finding that the claimant failed to specify any legal ground for the appeal and that his arguments could not be subsumed under the exhaustive grounds for illegality, rendering the appeal procedurally null.
