Inadmissibility of annulment challenge based on general assertion of non-guilt without satisfying exhaustive cassation grounds
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the petitioner’s request for annulment as inadmissible, upholding the underlying final criminal judgment, and ordered the petitioner to pay 200 RON in judicial costs to the state. The dispute arose from an appeal against a 2012 final criminal decision, where the petitioner argued a lack of guilt. The court held that the grounds for annulment were inadmissible because the petitioner’s arguments did not fall under any of the exhaustive cases for cassation provided by Article 386 of the Code of Criminal Procedure, thereby preventing the court from verifying whether the procedural deadlines set forth in Article 388 were met. The decision is grounded in Article 391(2) of the Code of Criminal Procedure, which restricts the extraordinary appeal to specific statutory grounds, and Article 192(2) regarding the award of costs.

Asupra cauzei de față;
192 alin. (2) C. proc. pen.,
