Transfer of case file denied as moot because underlying case already finally decided; request for annulment of judgment rejected.
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed, as moot, the applicants' request to transfer the case file (Dosar nr. 270/32/2013) from the Bacău Court of Appeal to another court, because the underlying case had already been finally decided by that court on 20 November 2013 (Decision no. 1646). The applicants had sought transfer on grounds of legitimate suspicion of bias and invoked Article 40(5), final sentence, of the Code of Civil Procedure, arguing the final judgment should be annulled as a matter of law; the court rejected this because proceedings had not been suspended pending the transfer request. Thus, no transfer order was issued, and the decision is final and not subject to appeal.
