Transfer request for case transfer moot after final judgment; motion rejected as object no longer exists

The High Court of Cassation and Justice (Civil Section I) rejected the applicant’s request to transfer the civil case (Dosar nr. 7186/90/2013 of the Vâlcea Tribunal) to another court, with no appeal available, thereby leaving the original tribunal’s jurisdiction intact. The applicant had sought the transfer based on claims of legitimate suspicion regarding the tribunal’s impartiality; however, the Court noted that the underlying case had already been resolved on 17 April 2014, and the Public Ministry’s representative argued for rejection. Decisively, the Court applied the procedural rule that a request for case transfer becomes moot when the case has already been decided, as the object of the transfer no longer exists, and found no basis to grant the motion under the applicable civil procedure provisions governing transfer for legitimate suspicion.
