Annulment of untimbered request for case transfer based on mandatory stamp duty compliance
Legislator summary
AI generatedThe High Court of Cassation and Justice annulled the petitioner's request for the transfer of a civil case from the Bucharest Sector 4 Court due to its failure to pay the required stamp duty, thereby denying relief to the petitioner and upholding the procedural default. The dispute centered on an application to transfer jurisdiction for a civil proceeding, where the applicant had also had a simultaneous request for judicial aid to waive stamp duty fees rejected, leaving the obligation to pay the 4 RON stamp tax unfulfilled. The court's decision was based on the mandatory nature of payment provisions under Article 20 of Law No. 146/1997 and Government Ordinance No. 32/1995, determining that the non-compliance with the timbre obligations rendered the transfer request formally invalid and subject to immediate annunciation without the possibility of appeal.
