Restitution order upheld as appeal nullity for wrong filing court not curable
Legislator summary
AI generatedThe court dismissed the defendant's appeal as unfounded, upholding the appellate decision that had nullified the defendant's earlier appeal; consequently, the first-instance judgment ordering the in-kind restitution of a property (a house and vineyard) to the claimant as heir of the former registered owner, under Articles 9(1) and 20(1) of the relevant restitution law, remains in force. The dispute arose from the defendant's appeal against the restitution order, which the appellate court had struck as void because the appeal was filed directly with the Court of Appeal rather than with the trial court that issued the judgment, violating Article 288(2) of the Civil Procedure Code. The Supreme Court held that this defect constitutes a matter of public order nullity under Article 388(2) read with Article 108(1) of the Civil Procedure Code, which may be raised by a party or the judge at any stage of the proceedings, thereby rejecting the defendant's argument that the nullity was cured by not being raised until the second hearing.

Asupra recursului civil de față;
288 alin.
312 alin. (1) teza a II–a C. proc. civ.
