Peremption of civil appeal due to one-year inactivity without suspensive or interruptive causes
Legislator summary
AI generatedThe High Court of Cassation and Justice ordered the peremption of the civil appeal declared by the plaintiffs and their successors against the 2002 appellate decision, which consequently remains in force. The dispute involved a civil case where the appeal had remained inactive in court records since June 2007 following a suspension due to the parties' failure to appear, without any subsequent action to resume proceedings. The Court determined that the appeal had lapsed *ipso jure* because it remained in a state of inactivity for more than one year due to the fault of the party, and no causes exist that would impede, interrupt, or suspend the statutory peremption term under the relevant procedural code.
