Motion to annul cassation remand denied as inadmissible after abandonment of grounds
Legislator summary
AI generatedThe court dismissed as inadmissible the appellants' motion to annul (contestație în anulare) brought under art. 318(1) C. proc. civ. against a prior High Court decision, thereby leaving that earlier decision in force; the appellants had requested annulment of the cassation order that had remanded the case to the appellate court, but they failed to file the required statement of grounds and later stated they no longer wished to pursue the motion. The case stems from a civil dispute in which the original claimant's appeal against an appellate decision had been upheld and the matter remanded for re-hearing; the respondents then challenged that remand. The court held the motion inadmissible because, under arts. 318 and 320 C. proc. civ., a contestation in annulment must be substantively motivated, and the movants' abandonment of the claim rendered the procedural challenge unsustainable.
