The High Court of Cassation and Justice (Civil Section I) rejected the applicant's motion to transfer (strămutare) the case pending before the Brașov Court of Appeal (Dosar nr. 1779/119/2013) to another court, with no further appeal; consequently, the case remains with the Brașov Court of Appeal. The applicant sought transfer citing legitimate suspicion (legitimă bănuială), noting that related criminal and insolvency proceedings had already been transferred, and filed the required court fee plus a copy of a prior decision of the Ploiești Court of Appeal; the Public Ministry opposed the motion. The court denied the request based on the assessment that the stated grounds did not meet the threshold for legitimate suspicion under the applicable procedural law, and noted the underlying case had been suspended under art. 242 alin. (1) pct. 2 C. proc. civ., without identifying any concrete circumstances warranting transfer.
