The High Court of Cassation and Justice (civil section) declined its own jurisdiction and transferred the case to the Ploiești Court of Appeal, which was ordered to hear the motion to transfer venue (strămutare) of a case pending before the Ploiești District Court. The motion sought to move a file registered on 27 August 2013, which fell under the new Code of Civil Procedure (in force since 15 February 2013). The court held that, under Articles 24, 131, and 142(1) of the new Code, a request for venue transfer based on legitimate suspicion is within the exclusive competence of the court of appeal when the originating court is a district court or tribunal in its circuit; therefore, the Ploiești Court of Appeal was the proper forum. The ruling was final (definitivă).
