Transfer of case over legitimate suspicion assigned to Bacău Court of Appeal, High Court declinings jurisdiction
Legislator summary
AI generatedThe High Court of Cassation and Justice (Civil Section I) declined its own jurisdiction and referred the case to the Bacău Court of Appeal, ruling that the Bacău Court of Appeal—not the High Court—is the competent court to decide the request for the transfer (strămutare) of a case pending before the Piatra Neamț District Court. The underlying dispute involves a request to transfer a file registered on 11 March 2014, after the entry into force of the new Civil Procedure Code (15 February 2013), based on a claim of legitimate suspicion (bănuială legitimă). The decisive legal basis is Article 142(1) of the new Civil Procedure Code, which vests jurisdiction over transfer requests based on legitimate suspicion in the court of appeal if the court from which transfer is sought is a district court or tribunal within its circuit; applied together with Articles 24 and 131, this made the Bacău Court of Appeal the material competent court. The decision is final.
