The High Court of Cassation and Justice dismissed the petition for the transfer of jurisdiction filed by the plaintiffs, upholding the prosecutor's recommendation against moving the case, resulting in no appeal available. The dispute concerned a procedural application to reassign Case No. 15494/180/2012 from the Bacău Court of First Instance to another tribunal, where the underlying judgment was suspended pending the resolution of this transfer request. The court's decisive legal basis rested on the evaluation of the petition's merits under the Code of Civil Procedure, determining that the grounds presented by the applicants did not justify exceptional jurisdictional reallocation, thereby keeping the case with the original instance court.
