The High Court of Cassation and Justice dismissed the motion to transfer the case, leaving the proceedings to continue at the Craiova Court of Appeal without appeal. The dispute concerned a procedural request by a plaintiff to relocate case no. 376/54/2013 from the Court of Appeal Craiova to a different jurisdiction, filed after the respondent submitted written conclusions on the merits. The court rejected the transfer application under the Romanian Code of Civil Procedure provisions governing the change of venue (strămutare), finding no legal basis to deviate from the statutory competence of the designated court, as evidenced by the fact that the scheduled hearing was imminent and the representative of the Public Ministry supported the admission of the request without the court granting it.
