Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the commercial lawsuit for procedural reasons, confirming that the original judgment of the Calarasi Commercial Court remains in force; the appellant commercial company had previously lost on the merits at both the first-instance and appellate levels. The dispute arose from a commercial claim where the appellant, having filed an appeal against the lower court's dismissal, failed to perform any procedural steps for a period exceeding six months after the case was suspended. Applying Articles 248 and 252 of the Code of Civil Procedure, the court determined that the appeal was automatically perished due to the party's failure to act within the statutory six-month timeframe for commercial matters, thereby rendering the prior appellate decision final and irrevocable.

SRL.
Împotriva acestei decizii a declarat recurs reclamanta S.C.I., criticând-o pentru nelegalitate.
242 alin. (1) pct.
