The Supreme Court of Cassation and Justice (High Court) ordered the annulment of the applicant's cancellation appeal (contestație în anulare) as unfiled due to the failure to pay the required judicial stamp fee, leaving the prior final decision of the same court intact. The dispute concerned a procedural challenge to a 2009 High Court decision that had upheld an appellate ruling, which had itself dismissed a civil appeal by striking down provisions of the old Administrative Procedure Law that permitted the incidental review of the legality of individual administrative acts issued before the enactment of Law No. 554/2004, on the grounds that such uncapped temporal review violated the right to a fair trial and legal security. The decisive legal basis for the current ruling is the mandatory nature of the prepayment of judicial taxes under Article 20 of Law No. 146/1997 (noted as 147/1997 in the text) and Article 9 of Emergency Government Ordinance No. 32/1995, which stipulates that non-payment of the judicial stamp fee results in the automatic annulment of the petition.

Asupra contestației în anulare de față;
