The High Court of Cassation and Justice declined jurisdiction over the appeal in nullity, ordering that the case be transferred to the Iași Court of Appeal, which remains the competent authority to resolve the dispute. The appellant challenged three civil judgments issued by the Iași Court of Appeal and Iași County Court regarding a claim for compensation for 800 m² of land expropriated in 1967, alleging that the appeal was not properly received because the targeted decisions were final and unappealable. Citing Article 319(1) of the Civil Procedure Code, which mandates that an appeal in nullity be filed with the court that rendered the attacked judgment, the High Court held that since no final judgment was issued by its own instance, it lacked jurisdiction; instead, the Iași Court of Appeal was designated as competent because the three contested decisions were rendered in the same proceeding and the only final judgments were those of that court.
