The High Court of Cassation and Justice dismissed the request for a change of forum, ordering that the civil case originally filed with the Brăd Court be transferred to the Cluj-Napoca Court, while preserving all procedural acts already completed; this decision is final and non-appealable. The dispute involved a request for a change of jurisdiction (strămutare) for a civil case pending before the Brăd Court, where the petitioner had filed a motion to hear the case in default and the respondent had submitted written notes, with the court noting an upcoming hearing date to address potential conflicts or logistical issues regarding the transfer. The court's decision was based on the procedural rules governing the transfer of cases between courts of equal jurisdiction, ensuring that the change did not prejudice the proceedings or violate the principle of procedural economy, as the request met the legal requirements for such a transfer.
