Land-restitution dispute transferred from Vâlcea to Cluj for suspected judicial bias.
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the request for case transfer (strămutare) filed by the petitioner and ordered that the civil case in Docket No. 1395/288/2009* be transferred from the Vâlcea Tribunal to the Cluj Tribunal, while preserving all procedural acts performed before the transfer; the decision is final and not subject to appeal. The petitioner, acting through its judicial liquidator, had sought the transfer citing legitimate suspicion of bias (bănuială legitimă) in a land-restitution dispute involving local and county land commissions and other parties, with the case having been suspended on the transfer date. The court based its ruling on the statutory grounds for case transfer due to suspicion of partiality, accepting the petitioner's arguments despite the prosecutor's contrary conclusion, and ordered the change of venue without invalidating prior proceedings.
