Withdrawal of appeal after filing motion to resume case following death of party
Legislator summary
AI generatedThe High Court of Cassation and Justice took formal act of the appellant's waiver of appeal, rendering the decision irrevocable, thereby leaving the Court of Appeal's suspension of the litigation in force. The case involved a civil proceeding where the Court of Appeal had suspended the trial of an appeal due to the death of a party pursuant to Article 243(1) of the Code of Civil Procedure; the appellant subsequently argued that lack of communication had necessitated the appeal but concurrently filed a motion to resume the case, leading to the withdrawal of the current appeal as it no longer had an object. The court applied Article 246(1) of the Code of Civil Procedure to record the waiver, confirming that the procedural status of the underlying litigation remains suspended pending the resolution of the motion to resume.

D E C I Z I A Nr. 2277 Dosar nr. 4797/2002
246 alin.
DECIDE:
Ia act de renunțarea la judecarea recursului.
Irevocabilă.
Pronunțată în ședință publică, astăzi 30 mai 2003.
