The High Court of Cassation and Justice admitted the exception of material incompetence and declined jurisdiction, referring the case to the Court of Appeal Galați as the competent jurisdiction. The dispute concerned a motion for the transfer of a case (strămوتare) filed by a petitioner against a defendant, which the Court assessed as falling outside its competence under the procedural rules. Relying on Article 142(1) of the new Code of Civil Procedure, which assigns motions for transfer based on legitimate suspicion against a court within the appellate court's jurisdiction to that appellate court, and applying Article 129(2) point 2 of the same Code ex officio, the Court determined it was not the proper forum to hear the request, thereby definitively transferring the matter to the designated appellate body.
