The High Court of Cassation and Justice rejected the appellant's second challenge for annulation against a prior decision by the same court that had previously dismissed his initial challenge to a civil ruling. The dispute involved a procedural attempt to re-contest an already final judgment, specifically a decision rendered in a first-instance civil matter that had become irrevocable under the law. The Court ex officio found the new filing inadmissible based on the procedural principle of the uniqueness of the right to appeal, which is exhausted upon its first exercise; since the underlying judgment was irrevocable under Article 377(2)(5) of the Civil Procedure Code and thus not subject to any further appeal under Article 320(3), the attempt to file a second challenge for annulation against a decision that itself could not be appealed was procedurally barred, leaving the prior dismissal intact.
