Transfer of case for legitimate suspicion referred to Bucharest Court of Appeal; High Court declines jurisdiction.
Legislator summary
AI generatedThe High Court of Cassation and Justice (Civil Section I) declined its jurisdiction and referred the case to the Bucharest Court of Appeal, which is the competent court to decide the request. The petitioner had sought the transfer of a case pending before the Călărași Tribunal to another equal court, citing legitimate suspicion (bănuială legitimă). Because the underlying case was filed after the new Civil Procedure Code took effect, Article 142(1) of that code grants the court of appeal jurisdiction over transfer requests based on legitimate suspicion when the lower court is a tribunal within its territorial circuit. Since the Călărași Tribunal falls under the Bucharest Court of Appeal's circuit, the High Court, applying Articles 131 and 142 of the new code, ruled that the Bucharest Court of Appeal is the proper forum and ordered the case transferred there. The decision is final and not subject to appeal.
