The High Court of Cassation and Justice annulled the appellant’s appeal for lack of payment as untimbraged, thereby leaving the lower court’s dismissal of the substantive claim in force. The dispute involved a real estate recovery action brought by the appellant, which was rejected at first instance and on appeal by the Bucharest Court of Appeal. Instead of addressing the merits or the procedural grounds cited by the appellant, the court prioritized the compliance with judicial stamp duty requirements, determining that the appellant failed to pay the required fee either in advance or by the scheduled hearing date. Relying on Article 20 of Law No. 146/1997 and relevant methodological norms, the court applied the mandatory consequence of annulment for non-payment, refusing to consider the substantive arguments raised under the Code of Civil Procedure.

Asupra recursului de față;
