Legislator summary
AI generatedThe High Court of Cassation and Justice annulled as unstamped the appeal (recurs) filed by the appellant against the Constanța Court of Appeal’s decision of 21 November 2011, which had already declared the appellant’s annulment challenge (contestație în anulare) as perimated. The appellant prevailed at no stage; the annulment stands. The dispute arose in an administrative-law context, where the appellant sought to challenge a prior Court of Appeal decision but failed to attach proof of payment of the judicial stamp duty and stamp tax to the appeal request. The Court applied Articles 3(m) and 11(1) of Law No. 146/1997 on judicial stamp duties, Article 3 of Government Ordinance No. 32/1995 on stamp duties, and Article 302¹(2) of the Civil Procedure Code, holding that the procedural obligation to pay and prove stamping remains mandatory, and, as the appellant did not remedy the omission despite being summoned, the appeal was annulled as unstamped under Article 20(3) of Law No. 146/1997 and Article 9 of Government Ordinance No. 32/1995.

Asupra recursului de față;
11 alin.
