The High Court of Cassation and Justice dismissed the motion to transfer jurisdiction filed by a limited liability company, upholding the competence of the Târgu Secuiesc Court of Law for the pending criminal case. The dispute concerned a request to move the trial from the court of first instance to an equal-level court elsewhere, alleging that the impartiality of the judges was compromised due to legitimate suspicion arising from the circumstances of the case and the parties' status during both investigation and trial. Relying on Article 55 of the Code of Criminal Procedure (as amended by Law No. 356/2006) and Article 192(2), the court determined that the grounds invoked did not constitute valid reasons justifying the transfer under statutory requirements, finding no sufficient basis to guarantee a fairer process through relocation. Consequently, the petition was rejected as unfounded, and the petitioner was ordered to pay 200 RON in judicial costs to the state and 500 RON to the opposing party.

Asupra cererii de strămutare de față;

192 alin. (2) C. proc. pen.
