The High Court of Cassation and Justice (Criminal Section) rejected as unfounded the petitioner’s application to transfer the trial of a case pending before the Craiova Court of Appeal (Case No. 10607/318/2012) and ordered the petitioner to pay 100 RON in judicial costs to the state; the decision is final. The petitioner sought transfer under the Romanian Criminal Procedure Code, arguing that he would not receive a fair trial because the judges’ impartiality might be compromised given the case’s circumstances and the parties’ status, and that his case had been tried abusively in his absence despite his filed request for adjournment pending the transfer motion. The court found that the asserted grounds did not fall within the exhaustively enumerated cases for transfer under Article 55 of the Criminal Procedure Code (as amended by Law No. 356/2006), and noted under Article 60(5) that the lower court could lawfully proceed with the case pending resolution of the transfer request, with any resulting judgment being quashed if the transfer were granted; absent any serious justification, the application was dismissed.

Asupra cererii de strămutare de față;

192 alin. (2) C. proc. pen.
