Appeal against final rejection of prosecutor's criminal complaint review held inadmissible under amended law.
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the petitioner's appeal against the Court of Appeal Craiova's criminal sentence no. 274 of 16 November 2012, which had rejected the petitioner's complaint against the prosecutor's resolutions declining to prosecute and upheld those resolutions. The lower court had denied the complaint as unfounded and ordered the petitioner to pay court costs; the High Court affirmed this outcome by refusing to entertain the appeal on the merits. The dispute arose from the petitioner's challenge to the prosecutor's refusal to initiate criminal prosecution, brought under Article 278¹ of the Romanian Code of Criminal Procedure, and the appeal was filed after the entry into force of Law No. 202/2010, which amended Article 278¹(10) to declare such first-instance decisions final and to remove the right of appeal. Because the challenged sentence was final under the amended law, the High Court found the appeal to be an unauthorized remedy and dismissed it as inadmissible pursuant to Article 385¹⁵(1)(a) C. proc. pen., also ordering the petitioner to pay 200 lei in judicial costs (100 lei for the court-appointed lawyer to be advanced from the Ministry of Justice's fund).

Împotriva acestei sentințe, în termen legal a declarat recurs petiționarul C.I.
38515 pct. 1 lit. a) C. proc. pen. va respinge ca inadmisibil recursul.
Văzând și disp. art. 192 alin. (2) C. proc. pen.
