The Tribunal da Relação do Porto partially allowed the appeal regarding the application of preventive detention to a defendant. The court ruled that while hearing the defendant is the general rule, its omission is merely irregular if not justified, and such defects must be raised within three days. Furthermore, the lower court's decision was dismissed because it failed to provide independent reasoning, merely copying the prosecution's arguments without addressing the specific case facts.
