The court dismissed the appellant's request for the return of the double deposit, ruling that mere delay does not qualify as definitive breach. The facts showed the buyer failed to pay rents and installed an unlicensed snooker table, which the seller argued justified contract resolution. Consequently, the court ordered the partial annulment of the first judgment and remanded the case for retrial to determine the buyer's liability.
