The court modified the appeal decision to allow the claim for lost profits based on expert testimony establishing the plaintiff's employment status. Evidence confirmed the plaintiff was a long-term, habitual driver for the defendant company with flexible hours, including weekends and nights, at the time of the accident. Consequently, the court ruled that the restricted answer to the jury question remained within the questioned scope and that future patrimonial damage must be compensated.
