Portuguese court rules a 32mm pistol is a particularly dangerous weapon regardless of minor injury caused.
Legislator summary
AI generatedThe Tribunal da Relação do Porto partially allowed the appeal regarding the criminal record transcription for a defendant convicted of using a firearm. Although the defendant argued that the minor injuries to the victim's thighs did not justify the weapon's classification, the court maintained that a 32mm pistol is inherently a particularly dangerous weapon under the Penal Code. Consequently, the court upheld the classification of the weapon but ordered that the criminal record not be transcribed in the certificates due to the lack of proven danger of future crimes.
