SUMÁRIO

I - Quando no artigo 772, n. 2 do Código de Processo Civil, se dispõe que o recurso não pode ser interposto se tiverem decorrido mais de cinco anos sobre o trânsito em julgado da decisão, não se inclui na previsão da norma os casos em que o acto seja absolutamente nulo, precisamente porque para tal situação o recurso de revisão será possível a todo o tempo.

II - A acção de declaração de nulidade é um acto preliminar do recurso de revisão, não fazendo parte dele mas antes o condicionando.
