Labor contract termination indemnity claims prescribed after one year; extra petitum penalty requires mandatory law application.
Legislator summary
AI generatedThe Tribunal da Relação do Porto dismissed the appeal regarding a labor contract termination indemnity, revoking the lower court's decision. The court held that such credits prescribe within one year from the termination date and that the extra petitum penalty under Article 69 of the Labor Procedure Code only applies when mandatory legal norms are invoked. Consequently, the claim was rejected due to the expiration of the limitation period and the failure to meet the statutory conditions for the penalty.
