20-year limitation for landlord's eviction claim expires before 1990 Housing Law applies, barring new claims.
Legislator summary
AI generatedThe Tribunal da Relação do Porto confirmed the lower court's dismissal of the landlord's eviction claim. The landlord argued that the new 1990 Urban Rental Law extended the limitation period for such claims, but the court found the 20-year deadline had already expired under the 1979 law. Consequently, the court ruled that the expired statutory limitation acts as a peremptory exception, preventing the landlord from invoking the newer, longer timeframe.
