The Tribunal da Relação do Porto revoked a previous decision regarding the execution of a mortgage judgment. The court held that mortgage registration serves only a declaratory function for property transfer, meaning the right passes independently of the registry entry. Consequently, the prior judicial mortgage registration prevailed over later registrations made by the transferees.
