Court holds procedural deadline is substantive, counted under Civil Code, and new law applies only prospectively.
Legislator summary
AI generatedThe Tribunal da Relação do Porto dismissed the counter-ordering appeal regarding the calculation of a procedural deadline. The court determined that the deadline in question is substantive in nature, requiring calculation under the Civil Code rather than the Code of Civil Procedure. Furthermore, the court ruled that the legislative amendment introduced by DL 244/95 lacks retroactive effect in cases where the original deadline had already expired under the previous law.
