The Tribunal da Relação do Porto remanded the criminal proceedings for a new trial due to insufficient factual findings regarding the specific roles of the three accused. The defense argued that the initial charge of material co-authorship incorrectly held all defendants liable for total damages regardless of their individual contribution, whereas the prosecution contended for parallel acts. The court ruled that the specific measure of participation for each defendant must be established before applying joint authorship rules under Articles 358 or 359 of the Criminal Procedure Code.
