Bankruptcy date fixes insolvency presumption against non-parties, requiring them to prove inaccuracy.
Legislator summary
AI generatedThe Tribunal da Relação do Porto confirmed the lower court's decision regarding the legal effects of a bankruptcy date. The court established that this date creates a rebuttable presumption of insolvency against third parties who did not intervene in the proceedings. Consequently, the burden of proof shifts to these non-parties to demonstrate the inaccuracy of the insolvency presumption.
