Não faria sentido que o legislador, que classifica como crime no Dec. Lei 117/91 a condução ilegal de motociclos e ciclomotores, não tivesse seguido o mesmo criterio relativamente aos veiculos automoveis ligeiros ou pesados, sendo maiores os riscos que da condução destes resultam, quando e certo que na propria lei de autorização legislativa se estabeleceu que devia ser definido o tipo legal de crime que sancione a condução de veiculo automovel sem habilitação legal para o efeito.
