The Tribunal da Relação do Porto dismissed the tenant's appeal regarding an eviction action based on a procedural defect. Although the landlord submitted an additional argument without notifying the tenant, the court found the defect cured because the tenant included the matter in their questionnaires and did not raise an objection. Consequently, the court ruled that the procedural flaw could not be resurrected in the appeal and upheld the original eviction judgment.
