Portuguese law holds that a bill of exchange acceptance endorsement is valid if tacitly indicated by the acceptor's signature position.
Legislator summary
AI generatedThe Tribunal da Relação de Lisboa confirmed the lower court's ruling that a tacit endorsement on a bill of exchange is legally sufficient. The appellant argued the lack of explicit text invalidating the acceptance, while the court noted the acceptor's signature appeared immediately below the title, creating a clear indication. The court ruled that Article 31 of the Negotiable Instruments Law allows for tacit indications, validating the endorsement based on the signature's placement.
